1. Introduction

These terms and conditions govern all services provided by Playtime Healing, operating from 11 The Parish Field, Clonakilty, with services delivered at various locations around West Cork and online (hereinafter referred to as “the Service Provider”, “we”, “us” or “our”).

By engaging with any of our services, you agree to be bound by these terms and conditions.

2. Acceptance of Agreement

The Client agrees to the terms and conditions outlined in this Agreement. This Agreement constitutes the entire and only agreement between the Service Provider and the Client, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Service Provider and Client relationship, the content, products or services provided and the subject matter of this Agreement.

3. Scope of Services

3.1 One-to-One Mindfulness Services

The Service Provider offers mindfulness-based directive interventions and non-directive therapeutic play skills education to individuals including children, teens, and adults, delivered at various locations in Clonakilty and West Cork, and online via Zoom. Services are provided on a one-to-one basis and are tailored to meet the specific needs and requirements of each individual client.

3.2 Mindfulness Group Sessions

The Service Provider offers group mindfulness sessions for children, which includes mindfulness education, arts and crafts, yoga concepts, physical activity and interaction with other children. Permission forms are to be signed by a parent/guardian for each child in attendance.

3.3 Mindful Sensory Play Sessions

Group sessions for toddlers and their guardians involving mindfulness practices, physical activity and interaction with other children. These sessions are designed to support children’s emotional regulation and wellbeing in a supportive group environment.

3.4 Online Courses and Digital Content

Educational courses and digital resources delivered through our online platform (MemberVault) with community support via Slack. These courses provide comprehensive training and ongoing support for parents and professionals.

3.5 Playtime Healing Birthday Parties

Playtime Healing birthday bookings are a private mindfulness group session for the birthday child and their friends, provided at €10 per child, unless otherwise agreed upon by Kerrie and the client. They are run for 1.5 hours and price includes all crafts and art materials. The price does not include decorations, cake, party foods or any other additional items.

Please note that it is a requirement that Kerrie receives signed permission from parents of all children attending the party that states that they give permission for their child to attend and partaking in a mindfulness workshop.  By booking playtime healing as part of your child’s birthday celebration, you agree to ensure that the sign in form is signed by all parents of children attending.

A deposit of €50 is to be paid to secure your booking, with remaining balance paid. At the end of the party.

4. Online Course Terms

4.1 Course Access and Platform Use

  • Course access is provided immediately upon successful payment through MemberVault
  • You will receive login credentials and Slack community invitation
  • Course materials remain accessible for the duration specified in your purchase
  • Access is personal and non-transferable
  • You are responsible for maintaining the confidentiality of your login credentials

4.2 Slack Community Guidelines

By participating in our Slack community, you agree to:

  • Participate respectfully and constructively with all members
  • Refrain from spam, promotional content, or off-topic discussions
  • Respect privacy and confidentiality of other members
  • Not share personal information of other participants
  • Follow guidance from community moderators
  • We reserve the right to remove members who violate these guidelines

4.3 Intellectual Property Protection

  • All course content, materials, videos, worksheets and resources are protected by copyright
  • Content is licensed for your personal learning and implementation only
  • Sharing, reproducing, distributing or reselling course materials is strictly prohibited
  • Screenshots, recordings, copying or downloading of content for distribution is not permitted
  • Violation of intellectual property rights may result in immediate termination of access

5. In-Person Service Terms

5.1 One-to-One Sessions

  • Clients are responsible for providing accurate and honest information regarding their personal circumstances, including any medical conditions or mental health issues that may impact their participation
  • Clients are responsible for attending scheduled appointments punctually
  • Cancellations or rescheduling requests must be made at least 24 hours in advance, except in cases of emergencies
  • Cancellations within 24 hours of respective booking will still be charged

5.2 Mindful Sensory Play Sessions

  • Guardians are responsible for the supervision and behaviour of their child/ren during sessions
  • Playtime Healing staff are not responsible for the direct supervision of children
  • Guardians must ensure their child/ren are in good health and free from contagious illnesses before attending
  • We reserve the right to refuse entry to any child displaying signs of illness
  • Guardians must provide consent for their child/ren to participate by enrolling and completing registration forms
  • Participation involves physical activity and interaction with other children
  • We may occasionally take photographs or videos for promotional purposes
  • Guardians who do not wish their child to be photographed must notify us in writing

5.3 Playtime Healing Birthday Parites

  • Playtime Healing birthday bookings are provided at €10 per child, unless otherwise agreed upon by Kerrie and the client. They are run for 1.5 hours and price includes all crafts and art materials. The price does not include decorations, cake, party foods or any other additional items.
  • The party can be booked at a studio or location, which does include an additional cost based off where is being used. Kerrie will discuss this prior to booking and an additional cost will be quoted dependant on location and hall prices etc.
  • Please note that it is a requirement that Kerrie receives signed permission from parents of all children attending the party that states that they give permission for their child to attend and partaking in a mindfulness workshop.  By booking playtime healing as part of your child’s birthday celebration, you agree to ensure that the sign in form is signed by all parents of children attending.

6. Payment Terms

6.1 General Payment Policy

Payment for services is due at the time of booking or before sessions commence, unless otherwise agreed upon in writing by both parties. Payment can be made via cash, bank transfer, Stripe, Sum Up, or any other method agreed upon by the Service Provider.

6.2 Refund Policy

One-to-One Sessions: Payment due at booking. Cancellations within 24 hours will still be charged.

Mindful Play Sessions: Fees must be made in advance and are non-refundable unless Playtime Healing cancels a session. In the event of cancellation by us, credit will be applied or a refund will be issued at the owner’s discretion.

Online Courses: Due to the digital nature of our courses, all course fees are final and non-refundable once payment is processed and access is granted.

6.3 Payment Processing

We use Stripe or Sum Up for secure payment processing. Your payment information is handled securely and we do not store payment card details.

6.4 Non-Payment Consequences

Failure to make payment may result in the cancellation of scheduled appointments and termination of services.

7. Client Responsibilities

You are responsible for:

  • Providing accurate and honest information about your/ your child’s circumstances and any relevant health information
  • Attending scheduled appointments punctually (in-person services)
  • Maintaining confidentiality of login credentials (online courses)
  • Following community guidelines in our Slack group
  • Ensuring children are appropriately supervised (mindful sensory play sessions)
  • Notifying us of any changes in circumstances that may affect participation

8. Confidentiality and Privacy

The Service Provider acknowledges and respects the confidentiality of all client information shared during the course of services. Client information will not be disclosed to any third party except where outlined in our Privacy Policy or where required by law, including safeguarding obligations under Irish regulations.

9. Limitation of Liability

9.1 General Limitations

The Service Provider shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the provision of services.

9.2 Service-Specific Limitations

In-person services: Clients acknowledge that mindfulness-based interventions and therapeutic play skills education involve inherent risks. We are not liable for any injuries or damages sustained during sessions.

Online courses: We are not responsible for technical issues with third-party platforms (MemberVault, Slack, Zoom) that may affect your access to services.

All services: Participation in any of our services is at your own risk. By booking your child into any of our services you are acknowledging that there is inherent risk involved in attending a session with other children. We are not liable for any injuries, damages, or losses sustained during participation.

10. Third-Party Platforms

Our services utilise third-party platforms including MemberVault (course delivery), Slack (community), Zoom (online sessions), Calendly/Bookwhen (scheduling), and Mailerlite (email communications). Your use of these platforms is also subject to their respective terms of service. We are not responsible for technical difficulties, outages, or issues with third-party platforms.

11. Photography and Promotional Content

For in-person sessions, we may occasionally take photographs or videos for promotional purposes. Participation in online courses may involve sharing in community spaces. If you do not wish to be included in any promotional materials, you must notify us in writing at hello@playtimehealing.ie.

12. Service Modifications

We reserve the right to alter the schedule, content, or format of any services without prior notice. Participants will be notified of changes through our usual communication channels.

13. Termination

13.1 Termination by Either Party

Either party may terminate services by providing written notice via email to hello@playtimehealing.ie.

13.2 Termination for Cause

We reserve the right to immediately terminate access to any service for:

  • Violation of these terms and conditions
  • Inappropriate behaviour in our community spaces or sessions
  • Repeated violations of community guidelines
  • Non-payment of fees
  • Any other justifiable reason

13.3 Effect of Termination

Upon termination, you remain responsible for payment of any outstanding fees for services rendered up to the date of termination. Access to course materials and community spaces will be revoked.

14. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Ireland.

15. Amendments

The Service Provider reserves the right to amend these terms and conditions at any time without prior notice. Any such amendments shall be effective immediately upon posting on our website or other communication channels. Continued use of our services constitutes acceptance of amended terms.

16. Entire Agreement

These terms and conditions constitute the entire agreement between the parties with respect to the provision of services and supersede all prior agreements and understandings, whether oral or written.
